Description
LANSING, J. Jesse Earl Stover was found guilty by a jury of one count of lewd and lascivious conduct with a minor, I.C. § 18-1508, based upon evidence that he had sexually molested a male child. He appeals his conviction, asserting that the trial court should have granted his motion for a mistrial after jail personnel prevented him from communicating with his attorney during an overnight recess. He also asserts that the court erred by admitting into evidence hearsay statements of the young victim, admitting a videotape of an interview of the victim, and excluding a videotape of a prior interview of the victim regarding unrelated allegations of abuse. Stover also contends that his sentence, a unified life sentence with a minimum period of ten years' incarceration, is unreasonable. We find no error by the trial court and no abuse of the court's sentencing discretion. Therefore we affirm.
